ELIGIBILITY: The Promotion is offered only electronically via the Internet. It is open to all natural persons age 18 and older, who are residents of a country in Asia, the United States or Canada for the duration of the Promotion, and who have Internet access as of the day before the Contest begins. Employees, officers and directors of Creative, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, their immediate family members and persons living in their same household are not eligible to participate in the Contest. No purchase necessary. Void where prohibited. All federal, provincial, state and local laws and regulations apply.

HOW TO ENTER: You may enter the Contest by going to http://www.myvado.com and completing the “True or False” question and registration form with your details and submitting it electronically. You will then be entered into a prize draw. You may also gain an additional entry in the prize draw for each nomination received from your friends. You can still enter the prize draw with nominations from friends even if you answer the “True or False” question incorrectly. In order to be eligible for a particular drawing, electronic entries must be received by Creative’s server no later than [11:59 p.m. PDT] on the last day of the Contest Period (31st December 2008). All entries become the exclusive property of Creative, and will not be acknowledged or returned.

Ten 5th Prize Winners will each receive a Creative water bottle (no retail value). If an entry is submitted within the time frame mentioned above. No alternative prize or other substitution is permitted except by Creative in the event of prize unavailability. All federal, provincial, state and/or local taxes and any import/export duties or customs fees are the sole responsibility of the winner.

SELECTION OF WINNER: Each winner will be selected by random drawing from all complete and eligible entries received, to be held on or about one week following the end of the Contest Period. All decisions are final and binding. Odds of winning will be determined by the number of eligible and correct entries received. Winners will be notified by email or mail at Creative’s discretion within 10 days of the drawing. Winner will have 15 days from notification to accept the prize by email or by mail. Creative is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner. Creative reserves the right to post winners’ names and country on the Internet.

Winners may be required to sign and return an affidavit of eligibility and compliance with contest rules release of liability, and, where lawful, a publicity consent agreement, all within 15 days of acknowledged notification. By accepting and/or using prize, winner agrees to the use of winner’s full name, voice, and/or likeness for the purpose of advertising, publicity, trade, or promotion of Creative and/or products without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed affidavit, consent and releases as required, prize may be forfeited and an alternate winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.

CONDITIONS: By entering, each entrant agrees to abide by and be bound by these Official Rules and the decisions of Sponsor, which shall be final in all respects relating to the Contest, including without limitation the interpretation of these rules. Creative, agents and representatives of Creative, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Creative that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest; or (vi) any printing or typographical errors in any materials associated with the Contest. Creative reserves the right, in its sole discretion, to suspend or cancel Contest in whole or in part at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest. Creative also reserves the right in its sole discretion, to modify the rules, make prize substitutions or cancel this contest without notice.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CREATIVE RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

By participating in the Contest, each entrant hereby releases and holds Creative and the employees, officers, directors, shareholders, agents, representatives of Creative, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

DISPUTES: As a condition of participating in this Contest, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, as follows: (a) if entrant is domiciled in U.S.A or Canada, before a court located in Santa Clara County, California having competent jurisdiction, which court shall apply the laws of the State of California without regard for doctrines of conflict of law; or (b) if entrant is domiciled outside the U.S.A or Canada, before a court located in Singapore, which court shall apply the laws of the Republic of Singapore. Further, in any such dispute, under no circumstance will entrant be permitted to obtain awards for, and hereby waives all rights to claim or receive punitive, incidental or consequential damages, or any other damages or costs, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and entrant further waives all rights to have damages multiplied or increased.
