General

1. The Maxis Broadband Mission Possible (‘Game’) is organised by Maxis Berhad (‘Maxis’) and is open to all Facebook users who are:

a) residents of Malaysia;
B) aged 18 years and above, participants below the age of 18 must obtain parental consent to participate legally.

2. The following group of persons shall not be eligible to participate in this Game:

a) permanent and/or contract employees of Maxis (including its associated and related companies) and their immediate family members (children, parents, brothers and sisters, including spouses); and/or
B) representatives, employees and/or agents of advertising and/or promotion service providers of Maxis.

About the Game

1. The Game is divided into three (3) Episodes over a period of seven (7) weeks. Each Episode comprises a different mission that needs to be completed. The participants need to clock the shortest time weekly and/or overall to win. After the seventh (7th) week, the Game will still be playable but there will be no prizes offered.

2. This Game is in no way sponsored, endorsed or administered by, or associated with, Facebook.

Game Period

The Game Period starts at 10am on 5 February 2010 and ends at 6pm on 25 March 2010.

Episode 1: Week 1 starts at 10am on 5 February 2010 and ends at 6pm on 11 February 2010.
Episode 1: Week 2 starts at 10am on 12 February 2010 and ends at 6pm on 18 February 2010.
Episode 2: Week 1 starts at 10am on 19 February 2010 and ends at 6pm on 25 February 2010.
Episode 2: Week 2 starts at 10am on 26 February 2010 and ends at 6pm on 4 March 2010.
Episode 3: Week 1 starts at 10am on 5 March 2010 and ends at 6pm on 11 March 2010.
Episode 3: Week 2 starts at 10am on 12 March 2010 and ends at 6pm on 18 March 2010.
Episode 3: Grand Prize Week 3 starts at 10am on 19 March 2010 and ends at 6pm on 25 March 2010

Game Rules

1. Participants have to be a member of Facebook. Sign up at http://www.facebook.com to be a member.

2. You can enter the Game through the Maxis Mission Possible application on the Facebook Platform. You can also find the application on the Maxis Broadband tab on the Maxis Page on Facebook. If Participants want to be updated when new Episodes and Winners’ list are released, they can become a fan of the Maxis Page.

3. Participants can play each Episode up to five (5) rounds a day. If Participants want to play extra rounds for that day, they can invite one (1) friend to participate and receive one (1) extra round.

Example: If a Participant invites eight (8) friends, he/she will receive eight (8) extra rounds to play for that day.

Participants can only invite friends who they have not previously invited and up to twenty (20) friends a day.

4. If Participants uninstall the application and install it again, their previous shortest time will be invalid.

5. In the unlikely event of a tie, the person who achieved the shortest time first during the Game Period will win.

Prizes and Prize Giving

1. There are three (3) Grand Prizes that will be given out at the end of the Game Period. Weekly Prizes are given out at the end of each week.

2. Weekly Prizes are given to the persons with the shortest time at the end of the week. Participants can only win one (1) Prize per Episode.

3. Episode 1 – Week 1 (starts at 10am on 5 February 2010 and ends at 6pm on 11 February 2010). Prizes are given to top ten (10) Participants with the shortest time taken to complete Episode 1.

If you’re an active Maxis Broadband subscriber, you get additional RM1,000 cash. 9 x RM500; and
If you’re an active Maxis Broadband subscriber, you get additional RM500 cash.

4. Episode 3 – Grand Prize Week

The Weekly Prize Winners, however, can still be in the running for the Grand Prizes. The Top ten (10) Participants with the shortest time taken to complete Episode 1 and Episode 2 and Episode 3 are eligible to participate for the Grand Prize Week.

5. The Grand Prizes (1st, 2nd, 3rd and 7 Consolation Prizes) are given to the top ten (10) participants with the shortest time taken to complete the Game during the defined Game Period. Participants can only win one (1) Grand Prize during the Game Period.

6. The time the Participant starts the Game and completes the Game is recorded online and the timing of each Participant is recorded and provided online. In the unlikely event of a tie whereby two (2) or more persons have the same shortest time, the person who achieved the shortest time first will win.

7. Winners will be notified via phone two (2) weeks after Winners are announced. Participants are encouraged to keep their mobile phones active during this period.

8. In the event the 1st Grand Prize Winner is under 18 years of age, a parent or guardian over the age of 21 years must be present to receive the Prize and during the Gold Coast trip. Maxis shall accept no liability or responsibility for any act or omission herein by the Participants or by their parents or guardians.

9. If a specified prize becomes unavailable due to unforeseen circumstances, Maxis may at its discretion, without notice, substitute a similar prize or one of equivalent value and all prizes are non-transferable and are not redeemable for cash.

10. Maxis shall not be held responsible or liable in the event that the Winner(s) cannot be contacted for any reason whatsoever; following efforts by Maxis to contact the Winner(s). In the event Maxis is unable to contact the particular Winner after attempting to do so for 3 consecutive days that Winner will automatically be disqualified The Prize will be awarded to the next Participant with the shortest time.

11. Maxis’ decision on the Winner shall be final and conclusive and no correspondence, complaint or appeal shall be entertained by Maxis at any time during or after the Game Period.

12. The Prize is non-transferable, non-assignable and non-exchangeable for cash.

13. The Prize may only be collected upon verification of the Winner’s Identity Card (NRIC) number and mobile phone number.

14. The Winner shall be responsible for any additional costs, duties, taxes and/or other incidental expenses which may be incurred as a result of and/or related to the Winner’s acceptance or use of the Prize.

15. All Prizes are used/accepted entirely at the risk of the Winner at all times and Maxis excludes all warranties in connection with any Prize to the extent permitted by law.

16. All prizes given are on an “As Is Where Is” basis and the title in the prize and any risk of loss or damage to the Prizes passes to the Prize Winner upon physical delivery of the Prizes to the Prize Winners. Maxis, its agencies, affiliates, sponsors and representatives are not responsible or obligated for misuse of any Prize, or for any claims, liability, loss, stolen or damage arising out of or in connection with and/or the Prizes associated with the Game.

Other Game Details & Terms and Conditions

1. By participating in the Game, the Participants agree to release and hold Maxis free and harmless of any all losses, damages, rights, claims and actions of any kind in connection with the Game or resulting from acceptance, possession, or use of any Prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy.

2. Maxis is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our website or network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.

3. Maxis reserves the right to, at any time without prior notice to vary, add to or amend any of the terms and conditions of the Game (including the Prizes, changing the dates of the Game Period and/or discontinuing the Game at any time) and Maxis shall not be liable for any loss or inconvenience resulting therefrom. By participating in the Game, the Participant agrees to be bound by the terms and conditions herein contained.

4. Maxis, reserves the right, in its sole discretion, to disqualify any Participant that is found or suspected of tampering with the Game submission process, the operation of the Game or to be in violation of the Conditions of Access of the web-site or usage policy of the website. Maxis reserves the right to disqualify any Participant and/or to forfeit any prize and/or reward from a Participant it believes has undertaken fraudulent practice and/or activities or other activities harmful to the Game or the Game submission process. Fraudulent activities is deemed to include but not be limited to the following:

(i) Any act of deceit and/or deception and/or cheating; and
(ii) Submission of entries and/or addition of friends, manipulating the system to win and participating by any person other than the natural person who is the named participating in the Game; and/or
(iii) Submission of entries and/or addition of friend wholly or partially by way of and/or generated by way of any electrical device, computer, pre-programmed modem or by any other method or device which contravenes the submission of entries and/or additions as stipulated in part (ii) herein above.

5. Maxis shall not be liable to the Participant or any other party for any loss or damage of whatsoever nature suffered by a Participant as a result of participation or non-participation in the Game or as a result of any act or omission on the part of Maxis.

6. The Winners may be required to attend and participate in a Prize-giving ceremony and/or other related events organized by Maxis, if any. Should the Winner fail to attend such ceremonies and/or events, Maxis reserves the right to forfeit the prizes.

7. By accepting the Prize, the Winner expressly grants permission to Maxis and its agencies to use the Winner’s name, photograph and/or likeness for purposes of advertising, editorial, promotional, marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law.

8. The Game shall in all respects be governed by the laws of Malaysia. However, it shall be the sole responsibility and obligation of the Participant and Winner to ensure that he/she complies with and does not contravene any laws to which he/she may be personally subject to.

9. The due observance and fulfillment of the above terms and conditions insofar as they relate to anything to be done or complied with by the Participant shall be conditions precedent to any entitlement (if any) of the Participant to receive a prize and/or reward pursuant to the Game.

This “Be Berryfied with DiGi” Facebook Upload Contest (“the Contest”) is organized by DiGi Telecommunications Sdn. Bhd. (201283-M) (“Organizer and or DiGi”). ELIGIBILITY
The Contest is open to Malaysian citizens and Non-Malaysian Citizens residing in Malaysia for more than six (6) months. By participating the Participants confirm they have obtained prior consent from their respective parents or guardians (if the participant is below 18 years of age). Employees of DiGi, their immediate families, affiliates, subsidiaries, advertising/promotional agencies, other related agencies and suppliers and their families are not eligible to participate. Blacklisted customers on any telecommunications network are not eligible to participate (collectively referred to as “the Participant”). DiGi reserves the sole and absolute discretion to exclude any Participant (who would otherwise be eligible) who as deemed by DiGi in its absolute discretion to be sub-standard, doubtful, bad or delinquent or in the event that the Contest is not conducted in a proper and satisfactory manner. CONTEST DURATION
The Contest duration is from 12.00am on 8th February to 11.59 p.m. on 14th March 2010 or any other period as specified by DiGi (“Contest Period”). HOW TO PARTICIPATE
The Participant is required to carry out the following:
1. Take a creative picture of the Participant himself using “a Blackberry”, according to the weekly themes that will be announced on DiGi’s Facebook page (www.facebook.com/myDiGi).

2. “A BlackBerry” as represented in the picture submitted can include that of the actual device, a cut-out of the actual device, a drawing of the actual device or any other possible permutations as long as it visually depicts the Blackberry device.

3. The weekly themes shall be announced every Monday, and will apply from Monday, 12.00am to Sunday, 11.59pm during the Contest Period.

4. Join the Fan Page of DiGi (www.facebook.com/myDiGi) and post the picture on the fan page wall. The Participant must tag DiGi Telecommunications and his friends on the picture submitted.

5. Winners will be contacted for verification via the winner’s Facebook profiles.The winner shall be required to provide DiGi with his contact number to facilitate the collection of the prizes. In the event that the winner does not provide his contact number as required by DiGi or DiGi is unable to reach any of these winners after three (3) voice call attempts per winner, then DiGi reserves the right to cancel the winner and forfeit the prize and the non-contactable winners shall have no claims whatsoever against DiGi on the cancellation and the forfeiture.

6. Winners will receive their prizes at the end of contest period. Delivery method will be communicated online. Failure of the winner to comply with the method of collection of the prizes shall entitle DiGi to cancel the winner and forfeit the prize and the non-contactable winners shall have no claims whatsoever against DiGi on the cancellation and the forfeiture. If the winner is unable to personally collect their prize, they can give a letter of authorisation to authorise another party to collect on his/her behalf. Idenitification of the authorised person must be produced. WINNER SELECTION
1. Weekly Prize winners are selected based on submissions done from each Monday, 12.00am – Sunday, 11.59pm during the Contest Period.

2. The 1 X Main Prize winner will be chosen among the 10 X Weekly Prize winners.

3. Each Participant can submit more than 1 picture during the Contest Period.

4. Each contest winner shall be entitled to one (1) prize only during the Contest Period regardless of the number of Contest entries submitted.

5. There will be 2 (two) weekly winners and 1 (one) consolation prize winner selected, every week, for the 5 (five) weeks.

6. DiGi will choose the weekly winners, and ultimately the Main Prize winner, based on the most creative picture posted. DiGi’s determination of the winners shall be final, conclusive and binding. No correspondence or claims will be entertained. The selection of the winners shall be at DiGi’s sole and absolute discretion.

7. The winners shall be announced online on DiGi’s Facebook page 3 days after each weekly round during the Contest Period. PRIZES Main Prize X 1: Blackberry Curve 8520

  • The Organiser reserves the right to substitute the Prizes with another at any time without prior notice. The Prize is non-refundable and non-exchangeable for any other prizes. DiGi reserves the right to replace any prize with another without prior notice.
  • Each contest winner shall be entitled to one (1) prize only regardless of the number of Contest entries submitted during the Contest Period.
  • All prizes must be claimed in Malaysia on or before14 April 2010. All unclaimed prizes will be forfeited. Any winner whose prize has been forfeited shall not be entitled to any payment or compensation.
  • DiGi is not a supplier of the product(s) offered for the prizes and shall not bear any liability in relation thereto.
  • DiGi reserves the right to disqualify any participation by the Participants and/or withhold the prizes aforementioned at DiGi’s sole and absolute discretion should the winners be found to be ineligible or it there are any fraud cases detected before the Prizes are handed over and/or delivered to the winners.

GENERAL TERMS AND CONDITIONS
1. The Participant agrees not to knowingly damage or cause interruption to the Contest and/or prevent others from entering the Contest. The Participant must ensure that the entries do not misrepresent an association or connection to some person, brand or thing that it does not actually have, and is not defamatory, libellous, vulgar, obscene, derogatory, pornographic, objectionable with respect to race, religion, creed, national origin, gender or sexual preference, or is otherwise inappropriate or unfit for publication or in any way that shall cause damage to DiGi’s reputation or prejudicial to DiGi in anyway what so ever.

2. The Participant shall ensure that they have obtained the relevant license or ownership of the entries from the relevant intellectual property rights owner and ensure that the entries do not infringe any third party’s intellectual property rights. DiGi shall not in any way be liable for any such infringement.

3. The Organiser reserves the right to change, amend and/or withdraw the Contest , the Contest mechanics and any of the terms and conditions herein without prior notice. In the event that the Organiser suspends or cancels the Contest due to any reason whatsoever, the Organiser may select a winner based on creativity from among all entries received for the Contest prior to the suspension or cancellation.

4. The Participant agrees that the Organizer may use the names and submissions, by citation, mention, reproduction or representation by making reference to and promotion of the Contest, without additional consideration and limitation in time or territory and in any media.

5. In case of any dispute, the Organiser reserves the right to make the final decision and no further correspondence or appeal will be entertained.

6. Proof of submission of entry is not proof of receipt. The Organiser and its respective parent companies, affiliates, subsidiaries, licensees, directors, officers, agents, independent contractors, advertising, promotion, and fulfilment agencies, and legal advisors are not responsible for and shall not be liable for: (a). telephone, electronic, hardware or software program, network, Internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including, without limitation to, the incorrect or inaccurate capture of entry information online; (B). late, lost, delayed, misdirected, incomplete, illegible or unintelligible e-mails; ©. failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed computer transmissions; (d). any condition caused by events beyond the control of the Organiser that may cause the Contest to be disrupted or corrupted; (e). any injuries, losses, or damages of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Contest; or (f) any printing or typographical errors in any materials associated with the Contest. (g) any claims by third party for infringement of intellectual property rights.

7. DiGi does not warrant that the Contest shall be uninterruptible and/or error free. By participating in the Contest, the Participant hereby acknowledges and irrevocably agrees that DiGi shall not in any manner whatsoever be liable for any interruption and/or any error arising from the Contest.

8. DiGi reserves the sole and absolute right to alter or terminate this Contest or any part thereof without giving any prior notice and no compensation in cash or in kind shall be given to the Participant and/or the Winners.

9. DiGi reserves the right to cancel, terminate or suspend the Contest with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by DiGi of the Contest shall not entitled the Participant to any claim or compensation against DiGi for any and all loss or damage suffered or incurred by the Participants as a direct or indirect result of the act of cancellation, termination or suspension.

10. DiGi shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Contest and/or the prizes, even if DiGi has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

11. By participating in the Contest, the Participant and the winners hereby agree and irrevocably and unconditionally undertake to fully absolve DiGi of all liabilities and agree to indemnify DiGi (on full indemnity basis) and hold DiGi harmless against any claim by any third party and against any loss, damage, cost or expense (including solicitors’ fees and cost) that DiGi may suffer or incur as a result of or in connection with the Contest and the prizes.

12. By participating in the Contest each Participant (or the Participant’s parent/legal guardian if entrant is a minor below 18 years of age) agrees to release and hold the Organiser, and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, and fulfilment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, use or misuse of any Prize, or travel to or from any Prize-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

13. The Organiser, and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising/promotion agencies make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any of the Prize, including, without limitation to, their quality, merchantability or fitness for a particular purpose.

14. By participating in the Contest, the Participant agrees to be bound by these Terms & Conditions and the decision of the judges is final and no correspondences shall be entertained.

15. Participant and Winners hereby irrevocably agree and give consent to DiGi to use the information or publish any related matter to the entries including and not limited to the Participant and Winners’ names, and photographs for current and future advertising and promotional purposes. All entries of the Contest shall become the property of DiGi.

16. All eligible Participants agree to be bound by the official rules and regulations and decisions of DiGi.

17. By participating in the COntest, the Participant agrees to be bound by these Terms & Conditions and the decision of the judges is final and no correspondences shall be entertained.

18. All other terms and conditions governing the use of any of DiGi’s mobile telecommunication services in relation to the utilization of the Contest shall apply herein mutatis mutandis.

HOW SONGS ARE JUDGED

Judges base their evaluations on the universal hallmarks of songwriting excellence: Engaging lyrics, creative use of language, effective and memorable melodies, and overall songwriting technique.


Lyric Only entries are judged using the same lyrical criteria — and the Judges evaluate each lyric to see how successfully it can be adapted to music.



RULES

The Juwita Suwito Song Contest is open to ALL songwriters, lyricists and music composers everywhere. This annual event is designed for amateur and semi-pro songwriters only. Individuals who earn over $5,000 in publishing royalties per year are not eligible. An entry fee is FREE (just make sure that you have sufficient credit to upload the your entry).

There is no limit to number of entries you can submit.
