Syarat – Syarat & Peraturan:-

• Peraduan NIVEA Men akan bermula dari 1 Mei 2013 hingga 30 Jun 2013 (“Tempoh Peraduan”). Beiersdorf (Malaysia) Sdn Bhd (“Penganjur”) berhak untuk memendekkan atau memanjangkan Tempoh Peraduan.
• Peraduan ini terbuka kepada semua rakyat Malaysia berumur 18 tahun dan ke atas (pada 1 Mei 2013) kecuali kakitangan pihak Penganjur (dan ahli-ahli keluarga terdekat mereka), pengedar-pengedar, peruncit-peruncit, agensi-agensi pengiklanan dan promosi pihak Penganjur.
• Hadiah-hadiah dibahagikan kepada tiga (3) jenis:                                                                                                                                                                                                                                                                                                                                                                                                               HADIAH PERTAMA: Satu tahun keahlian gimnasium X 20 pemenang

  HADIAH KEDUA: Satu tahun produk penjagaan NIVEA MEN bernilai RM250 setiap satu X 1,000 pemenang

  HADIAH SAGUHATI: Produk NIVEA MEN bernilai RM20 setiap satu X 3,000 pemenang

• Untuk hadiah satu tahun keahlian gimnasium, segala kos sampingan harus ditanggung oleh pemenang. Gimnasium yang terpilih adalah tertakluk kepada keputusan peganjur. Tawaran ini merangkumi keahlian gym untuk 12 bulan sahaja. Akses tanpa had ke semua club True Fitness di Malaysia.
• Simpan resit asal pembelian produk NIVEA Men yang turut serta bertarikh dalam Tempoh Peraduan sebagai bukti pembelian.
• Pemenang-pemenang layak dikehendaki untuk menjawab satu soalan mudah dengan betul sebelum disahkan sebagai pemenang. Sekiranya pemenang layak gagal menjawab soalan mudah dengan betul, pihak Penganjur berhak untuk membatalkan kelayakan pemenang layak tersebut.
• Kesemua hadiah mestilah dituntut atas perbelanjaan sendiri dalam tempoh 60 hari selepas tarikh pemberitahuan kemenangan hadiah. Hadiah-hadiah yang gagal dituntut 60 hari selepas tarikh pemberitahuan kemenangan hadiah akan dilupuskan oleh pihak Penganjur.
• Bukti kiriman tidak dianggap sebagai bukti penerimaan. Pihak Penganjur tidak akan bertanggungjawab ke atas penyertaan yang hilang, lewat atau tersilap alamat.
• Pihak Penganjur memiliki hak untuk mengganti sebarang hadiah dengan hadiah-hadiah lain yang sama nilainya tanpa sebarang notis. Semua hadiah tidak boleh ditukar milik atau ditukar untuk wang tunai.
• Serentak dengan penerimaan hadiah, para pemenang turut memberi kebenaran kepada pihak Penganjur serta agensi-agensinya untuk menggunakan nama dan/atau gambar mereka untuk tujuan publisiti, pengiklanan dan/atau perdagangan tanpa sebarang bayaran pampasan mahupun pemberitahuan.
• Dengan menyertai peraduan ini, para peserta bersetuju untuk mematuhi Syarat-Syarat dan Peraturan rasmi yang ditetapkan serta segala keputusan-keputusan pihak Penganjur. Keputusan para pengadil adalah muktamad. Sebarang perihal surat-menyurat tidak akan dilayan.
• Pihak Penganjur berhak untuk meminda Terma dan Syarat ini tanpa memberi notis terlebih dahulu.
• Untuk penebusan hadiah, hantarkan pelekat asli peraduan dan resit pembelian asal bertarikh dalam tempoh Peraduan melalui Pos Berdaftar atau Pos Laju ke: Peraduan Nivea Men, 26-2 Jalan USJ 9/5P, Subang Business Centre, 47620 UEP Subang Jaya, Selangor Darul Ehsan. Kesemua pelekat dan resit pembelian harus diterima selewat-lewatnya 8 Julai 2013. Penyertaan yang diterima selepas 8 Julai 2013 akan dibatalkan kelayakannya dengan serta-merta.

In this contest there are two [2] stages.

Stage 1: CREATE

To submit entries, participant must first complete the following steps:

• Create a milk shake recipe inspired by NESPRAY^® dairy milk by choosing two [2] out of eight [8] fruits, toppings and decorations available on the NESPRAY^® Beverage Creator Facebook App;
• Name your milk shake recipe inspired by NESPRAY^® dairy milk ; and
• Enter a slogan on why you would recommend your milk shake recipe to your friends, in not more than fifteen [15] words in either English or Bahasa Malaysia.

The top 10 winning entries in English and Bahasa Malaysia respectively from Stage 1 will be selected by a panel of judges to proceed to Stage 2 ["Finalists"]. The judging criteria will be based on, creativity and originality of the milk shake recipe name and slogan that best corresponds to the theme of this Contest.

Stage 2: VOTE

The Finalists from Stage 1 will be published for online voting starting from 12:00:01, 15 July 2013 and ending 11:59:59, 31 July 2013 ["Voting Period"].

The voting by members will constitute 50% of the total votes while the remaining 50% will be based on the judging by a selected panel of judges.

Based on the votes by members and judges, the top two [2] entries in English and Bahasa Malaysia respectively with the highest number of votes will be selected from the Finalists as the Grand Prize winners. For more information about this stage, read Rules & Regulations.

TERMA DAN SYARAT PERADUAN JACOB’S ‘MUM’S LITTLE SECRET’

1. Penganjur & Kelayakan

• 1.1 Peraduan Jacob’s “Mum’s Little Secret” (“Peraduan”) ini dianjurkan oleh Kraft Malaysia Sdn Bhd (Reg. No. 536551-W) [“Penganjur”].
• 1.2 Peraduan ini dibuka kepada semua warganegara Malaysia yang berumur 18 tahun dan ke atas pada 01 Mei 2013 (“Para Peserta”) dengan Kad Pengenalan Kebangsaan yang sah.
• 1.3 Golongan individu berikut tidak layak untuk menyertai Peraduan ini:
  1.3.1 Kakitangan pihak Penganjur (termasuk syarikat bersekutu dan berkaitannya) dan ahli keluarga terdekat mereka (anak, ibu bapa, adik-beradik, termasuk suami/isteri); dan/atau
  1.3.2 Wakil kakitangan, pekerja dan/atau ejen pembekal khidmat pengiklanan dan/atau promosi Penganjur (termasuk syarikat bersekutu dan berkaitannya) dan ahli keluarga terdekat mereka (anak, ibu bapa, adik-beradik, termasuk suami/isteri).

2. Tempoh

2.1 Peraduan ini akan diadakan dari 01 Mei 2013 (00:00) sehingga 30 Jun 2013 (23:59:59) (“Tempoh Peraduan”). Pihak Penganjur berhak meminda Tempoh Peraduan pada bila-bila masa sahaja tanpa memberi notis terlebih dahulu. Semua penyertaan diterima di luar Tempoh Peraduan akan dibatalkan secara automatik.
3. Mekanik Peraduan, Penghantaran Penyertaan & Kriteria Kelayakan

3.2 Para Peserta dibenarkan untuk menghantar lebih daripada satu (1) borang penyertaan selagi menepati kriteria jadual 3.1 di atas.

3.3 Setiap penyertaan yang dihantar tanpa bukti pembelian akan dibatalkan.

3.4 Bahan Penghantaran boleh dibuat dengan menggunakan Bahasa Malaysia, Bahasa Inggeris atau Bahasa Cina.
3.5 Bahan-bahan Penghantaran haruslah tidak mengandungi:-
3.5.1 Agenda menyinggung perasaan, perkauman, politik agama, kandungan yang mengapi-apikan agama, keganasan, bahasa kasar, kebencian penuh taksub atau kecederaan fizikal terhadap mana-mana kumpulan atau individu.
3.5.2 Mencadangkan apa-apa bentuk aktiviti yang menyalahi undang-undang, menjalankan kekesatan, mengugut, pencabulan dan/atau kelucahan.
3.5.3 Isi kandungan dengan hak cipta atau cap dagang milik pihak ketiga.
3.5.4 Pengiklanan untuk produk-produk, perkhidmatan atau laman web selain daripada produk produk JACOB’S.
3.5.5 Apa jua perubahan menggunakan perisian penyuntingan dari kandungan asal.
3.6 Para Peserta mestilah menjadi pemilik kepada Bahan Penghantaran atau di sisi undang-undangnya dibenarkan oleh pemilik untuk menghantar penyertaan bagi pihak beliau.
3.7 Para Peserta haruslah memastikan bahawa penyertaan mereka lengkap dengan butiran peribadi. Mana-mana penyertaan yang tidak lengkap, salah atau lewat akan dibatalkan secara automatik.
3.8 Penghantaran penyertaan boleh dibuat melalui pos atau halaman Facebook Jacob’s Malaysia.

• a) Penghantaran melalui borang penyertaan mestilah diposkan ke alamat Peraduan JACOB’S ‘Mum’s Little Secret’, Peti Surat 8866, Pejabat Pos Kelana Jaya, 46799 Petaling Jaya, Selangor Darul Ehsan. Setiap penyertaan hendaklah dihantar ke alamat yang dinyatakan melalui pos biasa. Bukti pengiriman tidak menandakan bukti penerimaan oleh Pihak Penganjur.
• b) Untuk penyertaan yang dibuat melalui Facebook, sila rujuk kepada Terma dan Syarat berasingan di Facebook Jacob’s Malaysia untuk maklumat lebih lanjut.

4. Hadiah-Hadiah

4.1 Keputusan Pihak Penganjur di atas kesemua hadiah-hadiah adalah muktamad.
4.2 Pihak Penganjur berhak, di atas budi bicara mutlaknya, menggantikan mana-mana hadiah dengan hadiah lain yang senilai dengannya, pada bila-bila masa, tanpa memberi notis terlebih dahulu. Semua hadiah diberikan dalam keadaan sedia ada dan tidak boleh ditukar. Gambar hadiah yang ditunjukkan di dalam borang penyertaan adalah untuk tujuan ilustrasi sahaja.

4.3 Hadiah-hadiah yang bernilai RM 100,000 seperti berikut akan dihantarkan:

4.4 Pemenang yang terpilih akan ditampilkan di dalam bahan pengiklanan Pihak Penganjur dimana pemenang diwajibkan untuk memenuhi permintaan Pihak Penganjur sebagai sebahagian pertimbangan untuk penganugerahan hadiah-hadiah.
4.5 Pihak penganjur berhak untuk menahan hadiah-hadiah tersebut jika jadual 4.2 tidak dituruti.

5. Kriteria Pengadilan

5.1 Pihak Penganjur akan memilih pemenang-pemenang berdasarkan kriteria berikut:
5.1.1 Kreativiti
5.1.2 Hubung-kait kepada tema peraduan
5.1.3 Keaslian
5.2. Keputusan Pihak Penganjur terhadap pemilihan pemenang-pemenang adalah muktamad dan surat-menyurat tidak akan dilayan.

6. Penebusan Hadiah

6.1 Pemenang akan diberi notis melalui emel dan/atau telefon daripada ruangan butiran-butiran peserta yang disediakan oleh Pihak Penganjur di dalam borang penyertaan.

6.2 Untuk mengutip hadiah, pemenang-pemenang mestilah menunjukkan Kad Pengenalan (KP) mereka untuk tujuan penyelidikan sebagai bukti identiti, yang mana jika gagal, hadiah-hadiah tersebut akan dibatalkan dan sebarang pertanyaan kemudiannya tidak akan dilayan.

6.3 Hadiah-hadiah haruslah dituntut oleh pemenang itu sendiri melainkan dengan kebenaran daripada Pihak Penganjur. Atas budi bicara Pihak Penganjur, pemenang mungkin dibenarkan untuk menyatakan wakil untuk mengambil hadiah. Dalam keadaan tersebut, wakil tersebut akan diminta untuk menyediakan salinan fotokopi Kad Pengenalan (KP) dan surat pengesahan kebenaran daripada pemenang bersama salinan fotokopi Kad Pengenalan (KP) pemenang yang telah disahkan untuk mengutip hadiah, jika gagal, hadiah tersebut akan dibatalkan dan sebarang pertanyaan kemudiannya tidak akan dilayan.

6.4 Pihak Penganjur tidak akan bertanggungjawab jika para pemenang tidak dapat dihubungi sekurang-kurangnya selepas tiga (3) kali percubaan (di hari dan waktu pejabat) oleh Pihak Penganjur atau ejennya untuk menghubungi pemenang, atas apa jua alasan. Semua hadiah mestilah dituntut dalam masa enam puluh (60) hari dari tarikh pemberitahuan. Semua hadiah yang tidak dituntut akan dibatalkan.

6.5 Pihak Penganjur tidak akan bertanggungjawab di atas ketiadaan resit atau kelewatan penyampaian notis pemberitahuan kepada para pemenang.

6.6 Semua pemenang haruslah mematuhi semua Terma dan Syarat yang ditetapkan oleh Pihak Penganjur, yang mana termasuk tetapi tidak terhad bagi menandatangani pengiktirafan berkaitan dan dokumen berhenti menuntut daripada pemenang-pemenang, sebelum sebarang hadiah dituntut, yang mana jika gagal, Pihak Penganjur berhak dengan budi bicara mereka untuk membatalkan hadiah daripada pemenang tersebut.

6.7 Sebarang keputusan daripada Pihak Penganjur terhadap Peraduan ini adalah muktamad dan terikat dan tiada sebarang pertanyaan (lisan atau bertulis) akan dilayan.

6.8 Pihak Penganjur dan syarikat bersekutunya (termasuk kakitangan, penasihat dan ejen) tidak bertanggungjawab terhadap peserta dari segi kontrak, tort atau kecuaian atau sebarang kerugian, kos, perbelanjaan, atau sebarang kerosakan (tidak langsung atau dari akibat) berlaku atau dihidapi oleh mana-mana peserta. Tanpa prejudis terhadap perkara diatas, Pihak Penganjur mempunyai hak untuk menukar, membatal, menggantung, menamatkan atau menunda peraduan ini tanpa liabiliti atau pampasan kepada mana-mana peserta atau pihak yang lain.

6.9 Dengan mengambil bahagian di dalam Peraduan ini, Para Peserta bersetuju untuk terikat dengan syarat-syarat dan peraturan-peraturan dan sebarang keputusan daripada Pihak Penganjur. Semua pemenang haruslah menepati Terma dan Syarat yang disertakan bersama hadiah, jika ada.

7. Liabiliti & Tanggungjawab

7.1 Pihak Penganjur, syarikat bersekutu dan berkaitannya, dan ejen dan syarikat berkaitan dengan Peraduan ini menafikan sebarang dan semua liabiliti berbangkit dalam Peraduan ini dan tidak akan bertanggungjawab di atas sebarang kerugian (termasuk, kerugian tanpa had, secara tidak langsung, istimewa atau berakibat atau kerugian keuntungan), perbelanjaan, kerosakkan, kecederaan atau kematian peribadi yang dideritai atau didapati (sama ada muncul daripada kecuaian mana-mana individu) akibat daripada penyertaan mereka di dalam Peraduan ini, tuntutan dan/atau penggunaan hadiah-hadiah, kecuali untuk sebarang liabiliti yang mana tidak boleh dikeluarkan daripada undang-undang (yang mana liabiliti itu adalah terhad kepada jumlah minimum yang dibenarkan oleh undang-undang). Peserta-peserta berjanji bahawa mereka tidak boleh membawa sebarang tuntutan atau tindakan menentang Pihak Penganjur atau syarikat bersekutu dan berkaitannya, samada di dalam kontrak, tort atau sebaliknya.

7.2 Semua pengangkutan, penginapan, perbelanjaan peribadi dan/atau kos-kos lain, yuran dan/atau perbelanjaan berkaitan yang disebabkan oleh penyertaan Peraduan ini dan untuk penebusan hadiah adalah sepenuhnya tanggungjawab pemenang.

8. Hak Pihak Penganjur

8.1 Semua penyertaan adalah harta Pihak Penganjur dan Para Peserta tidak akan menuntut, guna atau menyalahgunakan penyertaan untuk sebarang tujuan lain pada bila-bila masa. Dengan menyertai Peraduan ini, setiap Peserta bersetuju bahawa Pihak Penganjur berhak untuk menerbitkan, menggunakan nama dan/atau gambar pemenang sebagai bahan pengiklanan dan/atau untuk tujuan pertukaran publisiti tanpa sebarang bayaran atau notis terlebih dahulu, dan dengan persetujuan terlebih dahulu bahawa para pemenang diketepikan untuk dikaitkan bersama gambar mereka.

8.2 Pihak Penganjur mempunyai hak untuk menukar, menggantung atau membatalkan Peraduan ini pada bila-bila masa tanpa notis terlebih dahulu jika keadaan tidak dapatdijalankan mengikut perancangan, diganggu secara teknikal atau rosak, termasuk tetapi tidak terhad kepada dijangkiti virus komputer, pepijat, pengubahan, gangguan tidak sah, penipuan, kegagalan teknikal, atau mana-mana sebab diluar kawalan Pihak Penganjur, walaupun dengan usaha gigih daripada mereka.

8.3 Pihak Penganjur mempunyai hak untuk menukar Terma dan Syarat ini jika ianya diperlukan dari sebab-sebab yang sah, teknikal atau komersial dan sebarang penukaran haruslah mulai berkesan bermula dari penyelarasannya di laman web Peraduan. Sila semak Terma dan Syarat ini dengan kerap untuk melihat jika terdapat sebarang perubahan.

ENTRIES

1. Each participant may submit only 1 (one) entry to the Contest.

Organizer:

1. Petron Fuel International Sdn Bhd (“The Company”) is the organizer of this “450 total prizes to be won” Contest (“Contest”).

Eligibility:

1. This Contest is open to all Malaysians who are Smiles card members of the Smiles Driver Rewards Loyalty Program (“Smiles”), aged eighteen (18) and above (“Contestants”) and are subjected to the following Terms and Conditions. This Contest is not open to Fleet Card and Diesel Discount Card members. All transactions for the purpose of this Contest must be swiped to a Smiles card to be considered as a valid entry.
2. The following categories of Contestants are NOT ELIGIBLE to participate in this Contest:
   • Permanent/Contract Employee of the Petron Malaysia Refining & Marketing Bhd and Petron Oil (M) Sdn Bhd;

3. Customers who purchase a cumulative RM40.00 of Blaze fuel at any Petron station are entitled to two (2) lucky draw chances instead of just one (1) lucky draw chance when purchased at any Esso or Mobil station.
4. No contest forms or transaction receipts are required. Contestants are deemed eligible automatically when in compliance with all Terms and Conditions stated herein. 5. Based on all entries received, the Company will then begin to select the required number of Contestants (“Shortlisted Candidates”). 1. The Contest will run from 1 March 2013 at “12:00:01 hours and ends on 29 April 2013 at “23:59:59”, both dates inclusive (“Contest Period”) and is dividided into eight (8) rounds.

4. Each day will start at 12:00:01 hours and ends at 11:59:59 hours.
Shortlisting and Prize Redemption

1. Selection of Winners : The participant with the highest transaction amount at the end of each Day will be the winner. When a tie occurs, the selection of a winner will be determined by the Organiser based on whoever got correct answers to the questions given by the Organiser. The participants in concern (in a tie situation) will be contacted by the Organiser for a question and answer session.

2. Participants who are notified as the winner for the day will not be entitled for prizes in other days within the same Round or other Rounds during the Contest Period.

3. Notification of winners for each Day shall be declared within fourteen (14) days after each Round ends. Notification of winners for Round 8 shall be declared after the Contest Period ends.

4. Each participant can only win one (1) prize throughout the Contest Period.

5. The selection of winners shall be subject to satisfactory fulfillment of the entry criteria of the Contest of which is determined at the absolute discretion of the Organiser and shall be final.

6. Winners will be notified via email or mobile number or any other medium deemed appropriate to the Organiser. The Organiser will not be held liable in the event the winner(s) cannot be contacted for whatever reasons. The Organiser will not be held liable in the event of non-receipt or delayed delivery of the email notification.

7. Winners will be contacted by phone to collect their prizes. Winners are required to provide the Organiser with their personal details as and when required. All prizes will be available for collection at the place, date and time notified by the Organiser from time to time. All prizes must be claimed within thirty (30) days from the date of notification. All unclaimed prizes will be forfeited any enquiries thereafter will not be entertained.

9. All winners must abide by the terms and conditions of the parties arranging and/or providing for the prizes and the terms and conditions attached to the prizes, if any.

10. All prizes are given on an “as is” basis and are not exchangeable for cash, other items or voucher, in part or in full.
11. All prizes are used/taken entirely at the risk of the winner in all things, and the Organiser excludes all warranties in connection with any prize to the extent permitted by law.

12. The Organiser reserves the right, at its absolute discretion, to change the Prize(s) or substitute any one of the Contest Prize(s) with other item(s) of equivalent value at any time without prior notice.

13. In the event a winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of the Organiser subject to legislative requirements.

14. All decisions made by the Organiser in relation to the Contest including but not limited to the selection of winners and forfeiture of the Prizes shall be final, conclusive and binding. No correspondence or appeals will be entertained. The selection of the winners shall be subject to satisfactory fulfillment of the eligibility terms; entry criteria of the Contest and submission criteria of the Contest of which are determined at the Organiser’s sole and absolute discretion.

Liability & Responsibility

1. By participating in the Contest, participants shall be considered to have read, understood and agreed to be bound by the Terms and Conditions stated herein, including decisions of Organiser which are final, binding and conclusive.

2. Participation in the Contest and acceptance of the prizes hereby constitute an irrevocable permission granted by the participants and the winners, to the Organiser to use the name, address, NRIC, mobile number, email address and photographs of the winning participant(s) for purposes of advertisement and any other form of publicity associated with the Contest from time to time without any compensation or need for prior notification to the winners.

3. Winners shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident (including death) resulting from their participation in the Contest, redemption and/or usage of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) suffered by third parties or the participants in any mamer whatsoever during and after the Contest resulting form or arise out of the Contest.

4. All costs and/or any other costs, fees and/or related expenses that are incurred to participate in the Contest and redeeming the prizes are sole responsibility of the winners.

Rights of the Organiser
1. To the fullest extent permitted by the law, in no event will Organiser or any of its officers, servants, employees, representatives and /or agents (including, any third party service providers that Organiser may engage for purposes of the Contest) be liable for any loss or damages (including loss of income, profits or goodwill or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Contest, even if the Organiser has been advised on the possibility of such damages in advance, and all such damages are expressly excluded.

2. The Organiser’s decisions on all matters relating to the Contest shall be final and binding on the participants and winners. No correspondence, disputes and appeals will be entertained. At any time, the Organiser further reserves the rights to change, amend, delete and add any of the terms and conditions herein stated without prior notice and the participants agree to be bound by such changes, amendments, additions and deletions.

3. The Organiser at its absolute discretion reserves the right at any time to shorten or extend the Contest Period, if deemed necessary without prior notice.

4. The Organiser reserves the right to cancel, terminate or suspend the Contest for any reason whatsoever, without prior notice. For the avoidance of doubt, cancellation, termination or suspension of the Contest by the Organiser shall not entitle the Eligible Subscriber(s)to any claim or compensation against the Organiser for any loss or damage suffered or incurred as a direct and indirect result of the act of cancellation, termination or suspension.

5. The Organiser shall not be responsible in any way whatsoever, in respect of technical failures of any kind, unauthorized human intervention or electronic/ human errors in the administration and processing of the Contest.

6. The Organiser, its promoters and agents shall not be liable in any manner whatsoever for the following :

a) Any additional expenses incurred by the participants for taking part in the Contest;
b) Any sort of technical failure;
c) Intervention by unauthorized parties during the Contest Period;
d) Electronic or human errors in the administration of the Contest and processing of entries;
e) Any data entry that is lost, stolen, damaged, wrongly delivered or not received which is not due to the negligence or willful default of the Organiser.

7. The Organiser reserves the right to disqualify any person who it reasonably suspects has violated or infringed any of these general terms and conditions and the Organiser reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to the Contest, the Contest submission process and the MyMobile service application for the Contest.

8. The Organiser shall reserve the right to publish, use the names and any other personal data submitted by the participants/winners in promotion and/or advertising materials and the participants/winners shall not be entitled to claim ownership or other forms of compensation on the materials.

9. The Organiser reserves the right to recall any Prizes from any winner who it reasonably suspects has violated the eligibility of the Contest, in which event, the winner(s) are obliged to return the prize(s) to the Organiser. The Organiser also reserves the right to pursue legal action against any individual who it believes has fraudulently or failed to declare that he/she is not immediate family of the Organiser,its advertising agencies and related to the administration of the Contest.

Data Protection
1. By participating in the Contest and by submitting personal details with the Organiser, the Organiser agree to only collect it, use it for the purpose of the Contest and protect them as set out below. This section also outlines the Participants’ rights regarding data protection, and tells the Participant how to contact the Organiser.

2. At times the Organiser may retain third parties to process the Participants’ personal data. All such third parties are contractually obliged not to use the Participant’s personal data in any way other than that which is specified herein.

3. Under the Malaysian law, the participants’ rights include:

(a) a right to withdraw consent to the use of personal data at any time by contacting us at mymobile@myclear.org.my and providing the Organiser with the Participant’s name and email address for removal of the said personal data;
(b) a right to obtain a copy of the personal data which the Organiser hold [the Organiser reserves the right to charge a small fee to exercise this right]; and
© a right to have incorrect personal data be corrected.

4. If the Participants wish to raise any data protection issue with the Organiser, or exercise any of their legal rights, please contact the Organiser at mymobile@myclear.org.my.

5. The Organiser take reasonable precautions to keep the Participant’s personal data secure, and require third party data processors to do the same. Please note, however, that the Organiser may release the Participant’s personal data if required to do so by law, or by search warrant, subpoena or court order.

1. The Organiser will also publish the Contest terms and conditions in Bahasa Malaysia which is available at www.myclear.org.my/mymobile. In the event of irregularities or inconsistencies, the terms and conditions in English will prevail.
